Do you know that: If you buy non-regularized property (Ejido or Procede), you, as the buyer, could be responsible for the capital gains taxes (up to 40%) on the entire purchase price of the property. If the property is titled (Corret or Dominio Pleno) then the purchase price will be exempt from capital gains taxes when you sell the property or enter a bank trust. Zoning laws have existed in Sayulita since 2002 With the exception of the beachfront, the downtown area, and Calle Revolucion, all residential areas in Sayulita (H-127, H-84) are zoned expressly prohibiting "Hotel Installations, Motels, Inns, B & B, and Tourist Residences." Zoning prohibits third stories (including palapas) on single-family residences and town houses in most of the residential areas of Sayulita. There are off-street parking requirements for houses and residential developments. There are rear yard setback requirements (3 to 5 meters). Legal rental properties are required to be register with the Mexican tax authorities and pay value added taxes (I.V.A.) on their receipts. There is a lot to know about Mexican real estate practices and tax laws that are not normally disclosed during the purchase process.
